Full Journal pdf2014-03-10 Senate Journal Page 1911 SB 145 SENATE BILL NO. 145 "An Act relating to the Teachers' Retirement System, the Judicial Retirement System, and the Public Employees' Retirement System for qualified military service; relating to the definition of 'veteran' for purposes of housing, eligibility for veterans' loans, and preferences in state employment hiring; and providing for an effective date" was read the third time. 2014-03-10 Senate Journal Page 1912 Senator Wielechowski moved that the bill be returned to second reading for the purpose of a specific amendment, that being Amendment No. 1. Without objection, the bill was returned to second reading. Senator Wielechowski offered Amendment No. 1 : Page 1, line 4, following "hiring;": Insert "providing for home and community-based waiver services under Medicaid for children of military service members;" Page 9, following line 10: Insert a new bill section to read: "* Sec. 10. AS 47.07.045 is amended by adding new subsections to read: (c) If a child who is financially dependent on a military service member is eligible for home and community-based services while physically present in the state, the department shall provide for home and community-based services when the child returns to the state as though the child had remained in the state if the military service member provides proof acceptable to the department that (1) the member has maintained residency in the state for the period of eligibility; proof under this paragraph must include official military personnel records; (2) the member and the dependent child are physically present in the state and intend to reside permanently in the state while receiving the home and community-based services; (3) the member returned to the state within 18 months after separating from military service; and (4) the member's dependent child is not eligible for coverage of home and community-based services under another health insurance plan. (d) In (c) of this section, "military" means the armed forces of the United States, the United States Coast Guard, or the Alaska National Guard." The question being: "Shall Amendment No. 1 be adopted?" The roll was taken with the following result: SB 145 Second Reading Amendment No. 1 YEAS: 6 NAYS: 11 EXCUSED: 3 ABSENT: 0 Yeas: Egan, French, Gardner, Hoffman, Olson, Wielechowski Nays: Coghill, Dunleavy, Dyson, Fairclough, Giessel, Huggins, Kelly, McGuire, Meyer, Micciche, Stevens Excused: Bishop, Ellis, Stedman and so, Amendment No. 1 failed. SENATE BILL NO. 145 was automatically in third reading. The question being: "Shall SENATE BILL NO. 145 "An Act relating to the Teachers' Retirement System, the Judicial Retirement System, and the Public Employees' Retirement System for qualified military service; relating to the definition of 'veteran' for purposes of housing, eligibility for veterans' loans, and preferences in state employment hiring; and providing for an effective date" pass the Senate?" The roll was taken with the following result: SB 145 Third Reading - Final Passage Effective Date YEAS: 17 NAYS: 0 EXCUSED: 3 ABSENT: 0 Yeas: Coghill, Dunleavy, Dyson, Egan, Fairclough, French, Gardner, Giessel, Hoffman, Huggins, Kelly, McGuire, Meyer, Micciche, Olson, Stevens, Wielechowski Excused: Bishop, Ellis, Stedman and so, SENATE BILL NO. 145 passed the Senate. 2014-03-10 Senate Journal Page 1914 Senator Coghill moved and asked unanimous consent that the vote on the passage of the bill be considered the vote on the effective date clause. Without objection, it was so ordered and the bill was referred to the Secretary for engrossment.
